The entity that determines the purposes and means of this processing of personal data is NVALUE, a company incorporated under Swiss law with its registered office at Sunnestrahl 7 – 8834 Schindellegi (hereinafter also referred to as „NVALUE“ or „Data Controller“ or „Company“). We collect the following personal information from you when you visit our website:

• Contact information, such as your name, email address, and phone number.
• Demographic information, such as your age, gender, and location.
• Information about your interests and activities.
• Information about your use of our website, such as the pages you visit and the links you click.

The personal data provided – or otherwise acquired in accordance with the laws and contracts in at NVALUE, will be processed in accordance with the DPA and confidentiality obligations.

We will process your personal data:

• Personal data: all information relating to an identified or identifiable person (e.g. name, surname, e-mail).
• Data subjects: natural or legal persons whose data are being processed.
• Processing: any operation relating to personal data, whatever the means and procedures adopted, in particular the collection, storage, use, revision, communication, storage or destruction of data.
• Communication: e. making personal data accessible, for example by allowing access, transmission or publication.

We may share personal information with employees and/or personnel acting under the authority of the Data Controller (duly instructed for this purpose), as well as third parties bound to NVALUE by contractual relationship, for the purpose of fulfilling contractual obligations and fulfilling one or more of the purposes of the processing. These third parties will process the data provided as data processors or independent data controllers. Specifically, we may share the personal data collected with the following categories of recipients: a) subjects that provide services for the maintenance of the computer system used by NVALUE  and telecommunications networks (including tools and e-mail); b) companies or consulting and assistance companies (e.g. legal, tax advice, etc.); (c) competent authorities for compliance with legal obligations and/or provisions of public bodies, upon request; d) group companies for organizational, administrative and accounting needs.

Pursuant to the DPA, the Data Controller recognizes you, as a data subject, the following rights (non-exhaustive list):

• obtain the correction of inaccurate or obsolete personal data;
• be informed in writing and free of charge if personal data concerning you are being processed;
• revoke consent to the processing of data provided previously.
• prevent the communication to third parties of any sensitive personal data;
• obtain the portability of personal data or request that they be transferred to third parties;
• request the limitation or blocking of data processing, the prevention of communication of data to third parties or the rectification or destruction of personal data;
• request the prohibition of a specific processing of personal data and a specific communication of personal data to third parties or the cancellation or destruction of certain personal data;
• if neither the correctness nor the inaccuracy of the personal data can be proven, request the addition of a note indicating the objection;
• request that the rectification, destruction, blocking, especially communication to third parties, in addition to the note on the dispute or judgment be communicated to third parties or published;
• declare the processing of personal data unlawful.

Personal data may be transferred to third countries outside the Switzerland and the European Economic Area („EEA“), in accordance with the Decision of the IFPDT, ensures an adequate level of protection for personal data transferred from the European Union.

In other cases, the Controller transfers personal data in accordance with the requirements of the nLPD, included among others in Article LPD, in particular based on standard contract clauses.

Nvalue trades and sells green energy commodities in Switzerland, countries in Europe, Asia and the USA region.

• clients;
• brokers, suppliers, subcontractors and other business partners;
• domestic and foreign authorities or courts;
• the public, including users of our websites and social media;
• competitors, industry organizations, associations, organizations and other bodies;
• acquirers or parties interested in the acquisition of business divisions, companies or other parts of the Nvalue;
• other parties in possible or pending legal proceedings.

1. The Data Controller reserves the right to review, update, add or remove any part of this privacy policy at its discretion at any time. In case of changes, the update date will be indicated. 2. GDPR: our legal basis for collecting and using the personal data from clients of EEA (European Economic Area) according to GDPR and the purposes of our processes with your personal data are:
   • we need to execute a contract with you.
   • you have given us permission to do so the processing is in our legitimate interests, and it’s not overridden by your rights to observe with the law.
